1. Using the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You confirm that you are at least the age of majority in your province or territory (or are using the Site with the involvement of a parent or guardian) and that any information you provide is accurate. If you use the Site on behalf of an organization, you confirm that you are authorized to bind that organization to these Terms.
2. Our services
The Site provides information about Hunni Digital and our design, branding and marketing services. It is for general information only and is not an offer or a guarantee of any particular result.
Any services we provide to you are governed by a separate written agreement, proposal or statement of work. If there is a conflict between that agreement and these Terms, the signed agreement controls for that engagement.
3. Quotes and proposals
Prices, packages and timelines shown on the Site or in proposals are estimates and may change until they are confirmed in a signed agreement. A proposal is valid for the period stated in it, or for 30 days if no period is stated.
4. Intellectual property
The Site and its content — including text, graphics, logos, illustrations, layout and code — are owned by Hunni Digital or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to view the Site for your own informational use.
You may not copy, reproduce, republish, sell, or create derivative works from any part of the Site without our prior written consent. “Hunni Digital” and our logo are our trademarks and may not be used without permission.
5. Feedback
If you send us ideas, suggestions or feedback about the Site or our services, you agree that we may use them without restriction and without any obligation to you.
6. Client materials and confidentiality
Where you share materials with us through the Site (for example, in an inquiry), you confirm that you have the right to share them. Confidentiality obligations for client engagements are set out in the applicable engagement agreement.
7. Acceptable use
You must not: use the Site in any way that breaches applicable law; attempt to gain unauthorized access to the Site or its systems; introduce malware or other disruptive code; scrape, harvest or collect data from the Site except as expressly permitted; or use the Site to send unsolicited communications.
8. Third-party services and links
The Site includes third-party tools and links, including an embedded ClickUp inquiry form and references to platforms such as Shopify, Klaviyo, Zapier, Gorgias and Framer. We do not control these services and are not responsible for their content, availability or practices. Your use of them is subject to their own terms.
9. Disclaimers
The Site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that any information on it is accurate, complete or current.
10. Limitation of liability
To the fullest extent permitted by law, Hunni Digital and its directors, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of the Site.
Our total liability for any claim relating to the Site is limited to CAD $100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Hunni Digital from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your misuse of the Site or your breach of these Terms.
12. Privacy
Our collection and use of personal information through the Site is described in our Privacy Policy, which forms part of these Terms.
13. Changes
We may change the Site or these Terms at any time. Updated Terms take effect when posted on this page, shown by the “Last updated” date. Your continued use of the Site after changes are posted means you accept the updated Terms.
14. Suspension and termination
We may suspend or withdraw all or part of the Site, or your access to it, at any time and without notice, including if we believe you have breached these Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You agree that the courts of Alberta have exclusive jurisdiction over any dispute relating to the Site or these Terms, and you submit to the jurisdiction of those courts.
16. General
These Terms, together with any documents they refer to, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms; we may assign ours to a successor. Headings are for convenience only.
